These Terms of Service ("Terms") apply to your use of gentlerootbaby.com (the "Site") and to every purchase you make through it. The Site and the store are run by Gentle Root LLC, a Delaware limited liability company with its address at 8 The Green, Ste A, Dover, DE 19901, USA ("Gentle Root", "we", "us" or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Please read Section 15 (Governing law and disputes) carefully. It affects your rights.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract to buy from us or create an account. Our products are made for babies and toddlers, but the Site and our store are for adults only. We do not knowingly allow children to use the Site.
2. Your account
If you create an account, you agree to give accurate information and keep it up to date. You are responsible for keeping your login details safe and for activity under your account. Tell us right away if you think someone has used your account without permission.
3. Products and descriptions
We try to describe and show our products as accurately as possible. Colors may look different on different screens. Some lifestyle images on the Site are AI-generated or AI-edited illustrations; product photos show the actual products. See About our images. If something you receive is not as described, our 60-day money-back guarantee applies.
We may change, update or discontinue products at any time. Product availability is not guaranteed until we confirm your order.
4. Orders and pricing
Prices are shown in your local currency, for example U.S. dollars, British pounds or euros, and the total is shown at checkout before you pay. Prices, discounts and offers can change at any time, but a change will not affect an order we have already confirmed. For U.S. orders, sales tax is added at checkout where required. For orders shipped outside the United States, see Section 7 for import duties and taxes.
When you place an order, you are making an offer to buy. We accept your order when we ship it. We may refuse or cancel an order, for example if a product is out of stock, if there is an obvious error in price or description, if we cannot verify your payment, or if we suspect fraud or reselling. If we cancel an order after you have been charged, we will refund you in full.
We may limit quantities per person, per household or per order.
5. Payments
You agree to pay all charges for your order, including shipping and taxes shown at checkout. You confirm that you are authorized to use the payment method you provide. Payments are handled by third-party payment processors; we do not store your full card number. By providing a payment method, you authorize us and our payment processors to charge it for your order.
6. Optional add-ons
In your cart you can add optional Shipping Protection for $2.99 per order (shown in your local currency). It is never added automatically. If your package is lost, stolen or arrives damaged, we reship it at no cost as described in our Shipping Policy.
7. Shipping and risk of loss
We ship to the United States, the United Kingdom, the European Union and the other countries listed in our Shipping Policy, where shipping times and costs are also described. For orders shipped outside the United States, the destination country may charge import duties and taxes. We don't collect them at checkout and they are not included in our prices or shipping rates; they are paid by the buyer. Title to and risk of loss for products pass to you when the products are delivered to you. If a package is lost or damaged in transit, please contact us as described in our Shipping Policy.
8. Returns and refunds
Purchases are covered by our 60-day money-back guarantee, as described in our Refund Policy.
9. Product use and safety
Our products are aids that help you set up a calmer, safer home. They are not a substitute for adult supervision, and no product can prevent every accident or injury. You agree to read and follow the instructions, warnings and age ranges that come with each product and that are shown on the Site, to install and check products as instructed, and to stop using a product that is damaged, missing parts, or no longer suitable for your child. In particular:
- Gentle BumpBuddy is not a helmet or a safety device. Remove it for car seats, naps and sleep.
- Gentle HugGate is pressure-mounted and must never be used at the top of stairs.
- Gentle HugYard is not for sleep.
- Gentle RinseHug is not a bath seat. Never leave a child alone in the bath.
- Gentle HushMuffs are not a medical device.

10. Intellectual property
The Site and its content, including the Gentle Root name and logo, product names, text, images, graphics and software, belong to Gentle Root or its licensors and are protected by law. You may use the Site for your own personal, non-commercial shopping. You may not copy, reproduce, sell or create derivative works from any part of the Site without our written permission.
11. User content
If you send us reviews, photos, comments, questions or other content ("User Content"), you confirm that it is yours to share, that it is truthful, and that it does not violate anyone's rights or any law. You give us a non-exclusive, royalty-free, worldwide license to use, reproduce, display and adapt your User Content in connection with our business, including on the Site and in marketing. We will ask for your permission before we use your name, your photo or a photo of your child in marketing. We do not offer incentives for reviews. We may remove User Content at our discretion.
12. Acceptable use
You agree not to misuse the Site, including by breaking the law, interfering with the Site's security or operation, using bots or scrapers, placing fraudulent orders, or reselling our products without our permission.
13. Disclaimers and limitation of liability
Except as expressly stated in these Terms and in our policies, and to the fullest extent permitted by law, the Site and products are provided "as is" and "as available", and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Apart from our 60-day money-back guarantee, we do not offer a separate written warranty.
To the fullest extent permitted by law, Gentle Root and its members, managers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to the Site, the products or these Terms. Our total liability for any claim will not exceed the amount you paid us for the product or service that gave rise to the claim.
Some states and countries do not allow certain warranty disclaimers or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence where such limits are not allowed.
14. Indemnity
To the extent permitted by law, you agree to defend, indemnify and hold harmless Gentle Root and its members, managers and employees from any claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site or products, or your violation of any law or the rights of a third party.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules, except where the law of your state or country of residence requires otherwise. Nothing in these Terms limits the rights you have as a consumer under the mandatory laws of the country where you live.
Before filing any claim, please contact us at gentle.root.project@gmail.com so we can try to resolve it informally. Most concerns can be solved quickly this way.
Any dispute that is not resolved informally within 60 days will be brought exclusively in the state or federal courts located in Delaware, and you and we consent to the jurisdiction of those courts. Either party may bring an individual claim in small claims court where eligible.
16. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Changes apply to orders placed and use of the Site after they are posted.
17. Other terms
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours as part of a sale or reorganization of our business. These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, are the entire agreement between you and us about the Site and your purchases.
